Policy Overview

Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CatawbaChemicals.com, including any purchases, information, services, features, communications, and other interactions made available through the website.

Catawba Chemicals is a brand owned and operated by Vital Max LLC (“Catawba Chemicals,” “Catawba,” “we,” “us,” or “our”). By accessing the website, creating an account, submitting an order, purchasing a product, or otherwise using our services, you agree to these Terms and to any policies referenced in them.

If you do not agree to these Terms, you should not use the website or purchase products from Catawba Chemicals.

Eligibility and Acceptance

You must be at least 18 years old and have reached the age of majority required to enter into a binding contract in your jurisdiction in order to purchase products from Catawba Chemicals.

By using this website or placing an order, you represent that you have the legal capacity to enter into these Terms and that your use of the website and any products purchased from us will comply with all applicable local, state, federal, and international laws and regulations.

These Terms apply to website visitors, customers, businesses, laboratories, institutions, purchasing agents, resellers, and any other persons or organizations accessing or using our website or services.

We may refuse service, restrict access, reject an order, or terminate an account when we reasonably believe that use of our website, services, or products may violate these Terms, applicable law, our policies, or legitimate safety requirements.

When a product is designated for research use, laboratory use, formulation use, industrial use, or another restricted purpose, the purchaser agrees to comply with that designation.

No product sold by Catawba Chemicals may be used for human or veterinary diagnosis, treatment, consumption, administration, implantation, injection, ingestion, or other medical or therapeutic purpose unless the product is expressly marketed and labeled by Catawba Chemicals for that specific use and such use is lawful.

A product's permitted use should be determined from its specific product listing, packaging, labeling, available documentation, and applicable laws rather than from assumptions based on the product's name or chemical identity.

Purchaser Responsibility and Product Safety

The purchaser is responsible for determining whether a product is suitable and lawful for the purchaser's intended application.

By purchasing a scientific material, chemical, raw material, research compound, laboratory supply, or other technical product from Catawba Chemicals, you represent that you possess, or will obtain, sufficient knowledge and expertise to handle, store, transport, use, and dispose of the product safely and lawfully.

Purchasers are responsible for reviewing applicable labels, safety data sheets, certificates, technical documentation, handling instructions, storage requirements, and other relevant information before use.

You are responsible for informing employees, contractors, laboratory personnel, customers, downstream users, or any other persons who may handle a product of applicable hazards, precautions, handling requirements, and restrictions.

You are also responsible for any testing, validation, qualification, compatibility evaluation, or other assessment reasonably necessary to determine whether a product is appropriate for your intended application.

Catawba Chemicals does not assume responsibility for damage, injury, contamination, degradation, loss, or other consequences resulting from improper storage, misuse, unauthorized use, improper handling, combination with incompatible substances, failure to follow applicable safety information, or use outside a product's stated or lawful purpose.

Product Information and Documentation

We make reasonable efforts to provide useful and accurate product information, which may include product names, CAS numbers, molecular formulas, molecular weights, specifications, appearance, purity or assay information, storage information, technical data, images, certificates, safety documentation, and other product information.

Scientific and technical information may be obtained from manufacturers, suppliers, testing laboratories, published references, databases, product documentation, or internal records.

Product information is provided for informational and commercial purposes and should not be treated as a substitute for independent evaluation, professional judgment, appropriate testing, or applicable regulatory requirements.

Specifications, test methods, appearance, packaging, manufacturing sources, documentation formats, and other product characteristics may change from time to time.

Where documentation such as a Certificate of Analysis, Safety Data Sheet, technical specification, or other record is offered for a specific product or lot, that document should be interpreted according to the information expressly contained within that document.

The presence of documentation for one product or lot does not imply that identical testing, specifications, certifications, or documentation apply to every product offered by Catawba Chemicals.

Product Images and Descriptions

We attempt to represent our products accurately. However, photographs, renderings, packaging images, colors, dimensions, labels, containers, and other visual materials displayed on the website may differ from the product ultimately delivered due to packaging changes, manufacturing changes, display settings, supplier updates, or other reasonable variations.

Product descriptions, specifications, availability, and other information may be revised without prior notice.

Minor differences that do not materially change the identity or represented specification of the purchased product will not necessarily constitute a defective or incorrect product.

Orders and Order Acceptance

Submitting an order through our website constitutes an offer to purchase the products listed in the order. Receipt of an order confirmation does not necessarily mean that the order has been finally accepted or shipped.

We reserve the right to review, accept, reject, limit, or cancel an order when reasonably necessary, including in circumstances involving suspected fraud, payment issues, pricing errors, inventory shortages, product restrictions, unusual order quantities, regulatory concerns, shipping limitations, or suspected misuse of a product.

We may also request additional information before fulfilling an order when reasonably necessary to verify the transaction, purchaser, destination, or lawful nature of the purchase.

If we cancel an order that has already been paid, we will issue an appropriate refund for the cancelled portion of the order.

Pricing, Payment and Taxes

Unless otherwise stated, prices displayed on the website are expressed in U.S. dollars.

Product prices, promotions, discounts, shipping rates, and availability may change without prior notice.

You agree to provide accurate and current billing, payment, shipping, and contact information when placing an order.

You authorize Catawba Chemicals and our payment service providers to process the charges associated with your purchase using the payment method you provide.

Customers are responsible for applicable sales taxes, use taxes, customs charges, duties, import fees, brokerage fees, or other governmental or third-party charges associated with an order unless we expressly state otherwise.

We reserve the right to correct pricing, calculation, listing, or payment errors. If a material pricing error is discovered after an order is submitted, we may contact you with the corrected information or cancel and refund the affected item or order.

Availability and Product Changes

Products may be available in limited quantities.

We may add, remove, discontinue, restrict, substitute, repackage, or modify product offerings at any time, subject to orders that we have already accepted and applicable law.

Website availability indicators are not guaranteed to reflect inventory in real time.

We are not liable for the discontinuation of a product or for a product becoming temporarily or permanently unavailable.

Shipping and Delivery

Orders are generally processed within approximately two business days. Standard transit is typically approximately two to five business days after shipment, depending on destination, carrier operations, weather, holidays, and other circumstances.

Catawba Chemicals primarily ships within the United States using carriers that may include USPS and UPS. We may ship to eligible PO Boxes when supported by the selected carrier and service.

Orders qualifying under our current shipping promotion may receive free shipping when the order subtotal meets the applicable threshold displayed on our website. Our current standard threshold is $100 unless another offer or condition is displayed at checkout.

Processing and delivery times are estimates unless expressly stated otherwise. Carrier delays and circumstances outside our reasonable control may affect delivery.

Customers are responsible for providing a complete and accurate shipping address. Additional costs resulting from an incorrect, incomplete, or undeliverable address may be the responsibility of the customer.

Additional shipping terms are described in our Shipping Policy, which is incorporated into these Terms by reference.

Order Cancellations

Cancellation requests must be received before the shipping label for the order has been created and the order has entered the shipping process.

Once a shipping label has been created or an order has been shipped, the order cannot be cancelled.

A customer who no longer wants an eligible shipped product must follow our Returns & Refunds Policy after delivery.

We cannot guarantee that a cancellation request will be processed before fulfillment simply because the request was submitted before delivery. Customers should contact us as quickly as possible when requesting cancellation.

Returns and Refunds

Eligible customers may request a return within 30 days of delivery.

Returned products must be unopened, unused, and in their original condition and packaging unless the return relates to an incorrect, damaged, defective, or otherwise seller-responsible shipment.

Opened raw chemicals, research compounds, raw materials, and other products for which product integrity, contamination status, storage history, or chain of custody can no longer be reasonably verified are non-returnable.

For an eligible return arising from customer preference, ordering error, or another circumstance not caused by Catawba Chemicals, the customer is responsible for return shipping costs.

Returns resulting from customer error may be subject to a 10% restocking fee.

If Catawba Chemicals ships an incorrect product or an order arrives damaged or otherwise affected by a seller-responsible fulfillment error, we will work with the customer to provide an appropriate replacement, refund, return label, or other reasonable resolution depending on the circumstances.

Returns must be authorized before being sent back to us.

Complete conditions are stated in our Returns & Refunds Policy, which controls if there is any conflict concerning return eligibility.

Inspection and Claims

Customers should inspect packages and products promptly after delivery.

If an order appears damaged, incomplete, incorrect, or materially inconsistent with the order, contact Catawba Chemicals as soon as reasonably possible and provide sufficient information for us to investigate the matter.

We may request photographs of packaging, labels, shipping materials, product condition, lot information, or other documentation reasonably necessary to investigate a claim.

Customers should retain affected products and packaging until we advise that they may be discarded or returned.

Third-Party Products and Services

Some products sold by Catawba Chemicals may be manufactured, packaged, tested, distributed, or otherwise supplied in whole or in part by third parties.

Third-party products may be subject to manufacturer specifications, documentation, warranties, instructions, or restrictions in addition to these Terms.

Where an applicable manufacturer warranty exists, we may assist the customer with relevant information or claims where appropriate, but we do not create or expand a third-party manufacturer's warranty unless we expressly agree to do so in writing.

Our website may also use or provide access to third-party services, websites, payment systems, analytics providers, shipping providers, or other tools. Their services may be subject to their own terms and privacy practices.

Our website may contain links to websites, databases, references, manufacturers, laboratories, carriers, payment providers, or other resources operated by third parties.

A link does not necessarily constitute our endorsement of the third party or all content, products, claims, practices, or services offered by that party.

We do not control third-party websites and are not responsible for their availability, accuracy, security, privacy practices, or content.

Your use of third-party websites and services is subject to the terms and policies established by those third parties.

Intellectual Property

The Catawba Chemicals name, branding, logos, graphics, website design, product photography, packaging designs, written content, product presentations, databases, documentation created by us, and other original materials appearing on this website may be protected by copyright, trademark, trade dress, or other intellectual property laws.

Except where expressly permitted, you may not copy, reproduce, republish, distribute, modify, sell, license, create derivative works from, or commercially exploit our proprietary website content or branding without prior written permission.

Product names, trademarks, images, documentation, and other materials belonging to third parties remain the property of their respective owners.

Nothing in these Terms transfers ownership of any intellectual property to you.

Feedback and User Submissions

If you voluntarily provide reviews, suggestions, comments, photographs, feedback, or other materials to Catawba Chemicals, you represent that you have the right to provide that material and that it does not unlawfully infringe the rights of another person.

We may use non-confidential feedback submitted to us for legitimate business purposes, including improving our products, services, website, and customer experience.

We may remove or decline to publish website submissions that are fraudulent, unlawful, abusive, misleading, infringing, or otherwise inappropriate.

You remain responsible for statements and materials you submit.

By placing an order or otherwise interacting with Catawba Chemicals, you agree that we may send transactional communications reasonably necessary to operate our services, including order confirmations, payment information, shipping updates, account notices, customer service communications, fraud-prevention communications, and other service-related messages.

Promotional email or SMS communications will be subject to the applicable consent and opt-out requirements described at the time of signup and in our Privacy Policy.

Consent to marketing communications is not required as a condition of purchasing products unless otherwise permitted by applicable law.

You may not purchase or use a product in violation of applicable controlled-substance laws, chemical restrictions, export controls, hazardous-material requirements, environmental regulations, consumer-product laws, or other applicable legal restrictions.

You may not falsely represent the regulatory status, purity, identity, intended use, certification, testing status, manufacturer, or origin of a product purchased from Catawba Chemicals.

You are responsible for determining whether licensing, registration, permits, professional qualifications, documentation, or other approvals are required for your intended possession, resale, handling, transportation, formulation, or use of a product.

We may decline orders or restrict sales when reasonably necessary to comply with law, safety requirements, supplier restrictions, payment-risk controls, or our internal compliance standards.

Nothing on our website constitutes medical advice, veterinary advice, diagnosis, treatment advice, legal advice, regulatory advice, engineering advice, or another form of licensed professional advice.

Product descriptions, technical references, scientific literature, research summaries, or other informational materials should not be interpreted as instructions to use a product in a manner inconsistent with its labeling, lawful purpose, or applicable documentation.

Where professional evaluation is appropriate, you should consult a qualified professional familiar with your particular application.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and its content are provided on an “as available” basis.

This includes, where permitted by law, losses involving lost profits, business interruption, loss of data, loss of opportunity, replacement costs, or similar economic damages.

To the fullest extent permitted by applicable law, our aggregate liability arising out of a particular product transaction will not exceed the amount actually paid to Catawba Chemicals for the product or order giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Catawba Chemicals, Vital Max LLC, and their respective owners, officers, employees, affiliates, agents, contractors, and service providers from third-party claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the website, violation of these Terms, infringement of another person's rights, or unlawful, unauthorized, or improper use, handling, resale, distribution, or representation of products purchased from us.

This provision does not require indemnification for liability caused solely by conduct for which Catawba Chemicals or Vital Max LLC cannot lawfully disclaim responsibility.

Severability and Waiver

Our failure to enforce a provision of these Terms on one occasion does not constitute a waiver of our right to enforce that provision or another provision in the future.

Any waiver by Catawba Chemicals must be expressly authorized by us.

These Terms, together with our Privacy Policy, Shipping Policy, Returns & Refunds Policy, Product & Website Disclaimer, and any additional terms expressly presented in connection with a particular product, promotion, or service, constitute the applicable agreement between you and Catawba Chemicals concerning use of our website and services.

If a product-specific term directly conflicts with a general provision of these Terms, the more specific term will control with respect to that product or transaction to the extent of the conflict.

Governing Law and Disputes

These Terms and any dispute arising from or relating to the website, our services, or a transaction with Catawba Chemicals will be governed by the laws of the State of North Carolina and applicable federal law, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, disputes that cannot be resolved informally will be brought in a state or federal court having competent jurisdiction in North Carolina.

Before commencing formal litigation, we encourage customers to contact us and provide a reasonable opportunity to resolve the matter through customer service.

These Terms do not restrict any rights or remedies that cannot legally be waived under applicable consumer-protection law.
